Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Fluentive platform, including the website at fluentive.app and the application at app.fluentive.app. By creating an account or using Fluentive, you agree to these Terms.
1. Acceptance of Terms
By accessing or using Fluentive, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them. If you are using Fluentive on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
2. Description of Service
Fluentive is a cloud-based scheduling, task management, and client relationship platform designed for small businesses and professionals. We provide the service on a subscription basis, with a free tier and paid plans as described on our Pricing page.
3. Account Registration
To use Fluentive, you must create an account with a valid email address and password. You are responsible for:
- Keeping your login credentials confidential
- All activity that occurs under your account
- Notifying us immediately of any unauthorised access at info@fluentive.app
You may not share your account credentials with others or create accounts using false information.
4. Acceptable Use
You agree to use Fluentive only for lawful purposes and in accordance with these Terms. You must not:
- Use the platform to violate any applicable law or regulation
- Upload or transmit viruses, malicious code, or harmful content
- Attempt to gain unauthorised access to our systems or other users' accounts
- Use the platform to spam, harass, or harm others
- Reverse engineer, decompile, or disassemble any part of the service
- Use the service to store or process sensitive personal data beyond what is necessary for your legitimate business purposes
5. Subscription Plans and Billing
Free Plan
The free Trial plan is provided at no cost with limited features. We reserve the right to modify or discontinue the free tier with reasonable notice.
Paid Plans
Paid plans are billed monthly or annually as chosen at sign-up. Prices are displayed on our Pricing page and are exclusive of applicable VAT. VAT will be added at checkout based on your location.
Payment
All payments are processed by Stripe. By subscribing to a paid plan, you authorise Stripe to charge your payment method on a recurring basis. You must provide accurate billing information.
Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods, except as required by law or at our sole discretion.
Price Changes
We may change our prices with at least 30 days' notice. If you do not agree to a price change, you may cancel before the new price takes effect.
6. Your Data
You retain all ownership rights to the data you enter into Fluentive, including contacts, appointments, notes, and other content ("Your Content"). You grant us a limited licence to store and process Your Content solely to provide the service to you.
We do not sell or share Your Content with third parties except as described in our Privacy Policy. On account termination, you may export your data before deletion.
7. Intellectual Property
Fluentive and all associated software, design, trademarks, and content are owned by us or licensed to us. These Terms do not grant you any rights to our intellectual property except the limited right to use the service as described herein.
8. Service Availability
We aim for high availability and reliability, backed by Microsoft Azure infrastructure. However, we do not guarantee uninterrupted access to the service. We may perform scheduled maintenance (with advance notice where possible) or experience unexpected downtime.
9. Disclaimers
Fluentive is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability or fitness for a particular purpose. We do not warrant that the service will be error-free or meet all your requirements.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Fluentive shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service. Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.
Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence or wilful misconduct.
11. Termination
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. We will provide notice where reasonably possible. You may terminate your account at any time through account settings.
12. Governing Law
These Terms are governed by the laws of the European Union and the jurisdiction in which Fluentive is registered. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notification at least 14 days before taking effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
